Privacy Policy

1. Introduction

ATEF Energy, Inc. ("ATEF Energy," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit our website at atefenergy.com (the "Website"), submit an inquiry through our contact forms, communicate with us by email, or otherwise interact with our business in the course of evaluating, purchasing, or coordinating the supply of power equipment manufactured by ATEF Group of Companies.

ATEF Energy is a business-to-business organization. The Website and our communications are intended for engineering, procurement, project management, and executive personnel acting on behalf of their employers — utilities, data center operators, EPC contractors, renewable energy developers, industrial customers, and similar entities. We do not knowingly market to, or collect personal information from, individuals acting in their personal capacity as consumers.

This Privacy Policy also serves as our Notice at Collection under California law and as a general privacy disclosure to residents of other US states with applicable privacy regulations.

2. Scope of This Policy

This Privacy Policy applies to:

  • Information collected through the Website at atefenergy.com and any subdomains;
  • Information submitted through online inquiry forms, "Request a Quote" forms, "Contact" forms, and similar interactive features;
  • Information exchanged through email communications with ATEF Energy personnel;
  • Information collected during commercial discussions, project specification dialogues, and post-contract engagement, to the extent such information is processed by ATEF Energy in the United States;
  • Information collected through cookies and similar tracking technologies on the Website.

This Privacy Policy does not apply to information practices of ATEF Group of Companies' manufacturing facilities outside the United States, to third-party websites linked from the Website, or to information collected by our customers' or partners' own systems.

3. Information We Collect

We collect personal information in three principal ways: information you provide to us directly, information collected automatically through technical means, and information received from third parties in the course of business development.

3.1 Information You Provide Directly

When you submit an inquiry, request a quote, request a capability document, or otherwise contact us, you may provide:

  • Identifiers: name, professional title, business email address, business phone number;
  • Employer information: company name, business address, industry sector, geographic region or project location;
  • Project information: technical specifications, project requirements, voltage classes of interest, anticipated timelines, equipment scope, and any project-related details you choose to disclose in your inquiry;
  • Communication content: the text of messages, inquiries, attachments, and any subsequent correspondence.

We collect this information for the purpose of responding to your inquiry, evaluating your project, and conducting business with the organization you represent.

3.2 Information Collected Automatically

When you visit the Website, we and our service providers may automatically collect:

  • Device and connection data: IP address, browser type and version, operating system, device type, screen resolution, language preferences, referring URL;
  • Usage data: pages visited, time spent on pages, navigation paths, links clicked, search terms used on the Website, dates and times of access;
  • Cookies and similar identifiers: unique identifiers assigned to your browser or device, as further described in Section 6.

This information is collected to operate, secure, and improve the Website, to understand aggregate visitor behavior, and to support business development activities consistent with applicable law.

3.3 Information from Third Parties

We may receive limited professional contact information from third-party business data providers, industry directories, conference attendee lists, professional networking platforms, and publicly available business sources, for the purpose of identifying organizations and individuals who may have a legitimate business interest in our products. We use such information only to initiate or maintain business-to-business communication and we limit collection to professional contact details (name, employer, professional role, business contact information).

4. How We Use Information

We use the information described above for the following purposes:

  • Respond to inquiries and process requests for quotes, technical information, capability documents, and other business communications you initiate;
  • Evaluate and develop business opportunities, including assessing project requirements, preparing commercial proposals, coordinating manufacturing with ATEF Group facilities, and supporting project delivery;
  • Communicate with prospective and existing business contacts regarding products, capabilities, project status, technical updates, industry developments, events, and other information relevant to power equipment procurement;
  • Improve the Website and our services, including analyzing usage patterns, troubleshooting technical issues, and developing content responsive to visitor interests;
  • Protect against fraud, security incidents, and misuse of the Website and our communications channels;
  • Comply with legal obligations, including responding to lawful requests from government authorities, tax and accounting requirements, export control and trade compliance obligations, and contract administration requirements;
  • Establish, exercise, or defend legal claims, where necessary.

All marketing emails we send include an unsubscribe mechanism. You may opt out of marketing communications at any time by following the unsubscribe instructions in any such email or by contacting us as described in Section 14.

We do not use your personal information for automated decision-making that produces legal or similarly significant effects on you, and we do not engage in consumer profiling.

5. How We Share Information

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We disclose personal information only in the following circumstances:

  • Within ATEF Group: ATEF Energy may share project-related contact information and technical specifications with ATEF Group manufacturing facilities in Azerbaijan and Ukraine for the purpose of preparing proposals, manufacturing equipment ordered under contract, and coordinating project delivery. ATEF Group entities are bound by internal confidentiality and data handling obligations equivalent to those described in this Policy.
  • Service providers and processors: We use third-party service providers to operate our business, including website hosting providers, email service providers, customer relationship management (CRM) systems, analytics providers, electronic signature services, accounting and legal services, and logistics coordinators. These providers process information only on our instructions and only to the extent necessary to perform their services for us.
  • Professional advisors: Lawyers, accountants, auditors, insurers, and similar professionals, where engagement of such advisors requires access to relevant information.
  • Business transactions: In the event of a merger, acquisition, reorganization, financing, asset sale, or similar corporate transaction involving ATEF Energy, personal information may be transferred or disclosed as part of the transaction.
  • Legal compliance and protection: Where disclosure is required by applicable law, court order, subpoena, regulatory request, export control authority, sanctions screening obligation, or governmental investigation; or where disclosure is necessary to protect the rights, property, safety, or security of ATEF Energy, our personnel, our customers, or others.

We do not authorize any service provider or recipient to use disclosed personal information for purposes other than those for which it was disclosed.

6. Cookies and Similar Technologies

The Website uses cookies and similar technologies to function correctly, to remember your preferences, to understand how visitors use the Website in aggregate, and to support our business development activities. We use the following general categories:

  • Strictly necessary cookies, which enable core Website functionality such as page navigation, security, and form submission. These cookies cannot be disabled without affecting Website function.
  • Analytics cookies, which collect aggregated information about how visitors interact with the Website, including pages viewed, time on site, and traffic sources. We use this information to improve the Website. Analytics providers we engage may include Google Analytics or comparable services.
  • Business platform cookies, which support our use of professional networking and business outreach platforms, including LinkedIn and similar B2B platforms. These cookies may allow such platforms to recognize that you have visited the Website.

You can manage cookies through your browser settings. Most browsers allow you to refuse cookies, delete existing cookies, or be notified when cookies are set. If you disable cookies, some Website features may not function as intended.

The Website does not currently respond to "Do Not Track" browser signals, as there is no industry-standard interpretation of this signal at the time of publication.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including for the duration of any business relationship or active project, and for additional periods required by:

  • Applicable contract administration, warranty, and after-sales support obligations;
  • Tax, accounting, audit, and regulatory recordkeeping requirements under US federal and state law;
  • Export control, sanctions screening, and trade compliance recordkeeping;
  • Statutes of limitation governing potential legal claims;
  • Internal record retention policies.

Business inquiry information from prospective customers with whom no business relationship is established is generally retained for up to two (2) years from the date of last contact, after which it is deleted or anonymized unless a longer retention period is required by applicable law.

Information collected through Website analytics is retained in accordance with the default retention settings of our analytics service providers, generally not exceeding twenty-six (26) months in identifiable form.

8. Data Security

We implement administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or destruction. These safeguards include access controls, encryption of data in transit, secure storage of business records, vendor due diligence requirements, and personnel training on confidentiality and data handling.

No method of electronic transmission or storage is entirely secure, and we cannot guarantee absolute security. If you become aware of any actual or suspected unauthorized use of your information in connection with the Website or our communications, please contact us promptly using the information in Section 14.

9. Your Privacy Rights

9.1 California Residents (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), provides you with the following rights with respect to personal information we hold about you:

  • Right to know the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for which we collected it, and the categories of third parties with whom we have shared it;
  • Right to delete personal information we have collected from you, subject to legal exceptions (including retention required for contract performance, legal compliance, security, and the establishment or defense of legal claims);
  • Right to correct inaccurate personal information we hold about you;
  • Right to opt out of the sale or sharing of personal information. As stated above, we do not sell personal information and do not share personal information for cross-context behavioral advertising;
  • Right to limit the use and disclosure of sensitive personal information. We do not collect or use sensitive personal information for any purpose beyond what is reasonably necessary to provide our services;
  • Right to non-discrimination for exercising any of the rights above.

To exercise any of these rights, contact us as described in Section 14. We will verify your identity before responding to your request, typically by confirming information that matches our records. You may designate an authorized agent to make a request on your behalf, subject to verification of the agent's authority.

For the twelve (12) months preceding the Effective Date of this Privacy Policy, the categories of personal information we collected, the sources from which we collected it, the purposes for which we collected it, and the categories of recipients are described throughout Sections 3, 4, and 5 above. We did not sell or share personal information for cross-context behavioral advertising during this period.

9.2 Other US State Privacy Rights

Residents of Virginia, Colorado, Connecticut, Utah, Texas, and other US states with comprehensive privacy laws may have rights similar to those described in Section 9.1, including rights of access, correction, deletion, portability, and opt-out from certain processing activities. To exercise any such right, contact us as described in Section 14, identifying the state in which you reside. We will respond within the timeframes required by applicable law.

9.3 European Economic Area, United Kingdom, and Switzerland Residents

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the General Data Protection Regulation and equivalent laws may apply to our processing of your personal information. Where applicable, we process personal information on one or more of the following legal bases:

  • Legitimate interests in conducting business-to-business commercial activity, communicating with professional contacts, securing our systems, and developing our products and services;
  • Performance of a contract to which you or your employer is a party;
  • Compliance with a legal obligation to which we are subject;
  • Consent, where required and where you have provided it.

You may have the right to access, correct, delete, restrict, or object to the processing of your personal information, the right to data portability, and the right to withdraw consent where processing is based on consent. You may also have the right to lodge a complaint with the data protection authority of your country of residence.

10. International Data Transfers

ATEF Energy operates in the United States and works with ATEF Group manufacturing facilities in Azerbaijan and Ukraine. Personal information you provide may be transferred to, processed in, and stored in the United States and in countries where ATEF Group operates, where applicable data protection laws may differ from those of your country of residence.

Where we transfer personal information of European Economic Area, United Kingdom, or Swiss residents to jurisdictions that have not been recognized as providing an adequate level of data protection, we implement appropriate safeguards, including Standard Contractual Clauses approved by the European Commission, supplemented by additional contractual and technical measures as appropriate.

11. Children's Privacy

The Website and our services are directed exclusively to business professionals acting on behalf of their employers. We do not knowingly collect personal information from children under the age of sixteen (16). If we become aware that we have collected personal information from a child under sixteen, we will delete that information.

12. Third-Party Links

The Website may contain links to third-party websites, including the websites of ATEF Group entities, industry associations, regulatory bodies, and professional platforms. These third-party websites operate under their own privacy policies, which we do not control. We recommend reviewing the privacy practices of any third-party website before providing personal information to it.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, in applicable law, or in the services we provide. The "Effective Date" and "Last Updated" dates at the top of this Privacy Policy indicate when it was most recently revised. Material changes will be communicated through a prominent notice on the Website or, where required by law, by direct notice to affected individuals. Continued use of the Website following the posting of an updated Privacy Policy constitutes acknowledgment of the updated terms.
